Service Description: Our Service provides a no-code notification platform that enables customers to add notifications (like email and SMS) to their apps through a visual drag-and-drop interface, operating as a service layer on top of customer databases without requiring API integration.

Registration Obligations: You may be required to register with Notika AI or provide information about yourself (e.g., name, email address) to access and use certain features of the Service. You agree to provide and maintain true, accurate, current, and complete information about yourself as prompted by the Service’s registration form. Registration data and certain other information about you are governed by our Privacy Policy. If you are under 13 years of age, you are not authorized to use the Service. If you are under 18 years old, you may use the Service only with the approval of a parent or guardian.

Account, Password, and Security: You are responsible for maintaining the confidentiality of your account details and for all activities that occur under your account. You agree to (a) immediately notify Notika AI of any unauthorized use of your account or other security breaches, and (b) ensure that you exit from your account at the end of each session. Notika AI will not be liable for any loss or damage from your failure to comply with these obligations.

Modifications to Service: Notika AI reserves the right to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice. You agree that Notika AI will not be liable to you or any third party for any modification, suspension, or discontinuance of the Service.

Fees: If your usage exceeds the amount set on our free plan, you agree to pay the fees listed on the Notika AI pricing page for the usage incurred during that billing period (“Fees”). You agree to provide accurate and complete billing information and promptly update your account information of any changes (e.g., a change in billing address or credit card expiration date). By signing up for a subscription, you authorize Notika AI to bill your payment method on a recurring basis until you terminate your account.

If you dispute any charges, you must notify Notika AI within sixty (60) days after the date you are charged. Notika AI reserves the right to change its prices, with notice given at least thirty (30) days before the change takes effect. You will be responsible for all taxes associated with the Service, other than taxes based on Notika AI’s net income.

Payment Processing: Notika AI does not process payments for its Services. Payments are facilitated through a third-party payment processor, Stripe, Inc. By agreeing to these Terms, you agree to be bound by Stripe’s terms and conditions, available at Stripe’s website. Notika AI assumes no liability or responsibility for any payments made through Stripe.

Refunds and Cancellations: Payments made are final and non-refundable, except as determined by Notika AI. You may cancel your subscription by contacting us at support@notika.ai.

Service Content: The Service may contain content or features (“Service Content”) protected by copyright, patent, trademark, trade secret, or other proprietary rights. Except as authorized by Notika AI, you agree not to modify, copy, frame, scrape, rent, lease, loan, sell, distribute, or create derivative works based on the Service or the Service Content.

Trademarks: The Notika AI name and logos are trademarks of Notika AI. Other product and service names used in connection with the Service may be trademarks of their respective owners. Nothing in these Terms grants you the right to use any Notika AI trademarks without our prior written permission.

The Service may provide links to third-party services and websites (“Third-Party Services”). Your use of such Third-Party Services is subject to their terms and conditions. Notika AI does not control or endorse Third-Party Services and is not responsible for their content, privacy practices, or any damages arising from your use of Third-Party Services.

You agree to defend, indemnify, and hold harmless Notika AI, its affiliates, officers, employees, and agents from any and all claims, damages, obligations, losses, and expenses arising out of or relating to your use of the Service, any Content you post, your connection to the Service, your violation of these Terms, or your violation of any rights of another.

YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK. THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. NOTIKA AI DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. NOTIKA AI DOES NOT WARRANT THAT (A) THE SERVICE WILL MEET YOUR REQUIREMENTS, (B) THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, (C) ANY INFORMATION OBTAINED FROM THE SERVICE WILL BE ACCURATE, OR (D) ANY DEFECTS IN THE SERVICE WILL BE CORRECTED.

NOTIKA AI WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR OTHER INTANGIBLE LOSSES ARISING FROM OR RELATED TO YOUR USE OR INABILITY TO USE THE SERVICE. NOTIKA AI’S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM YOUR USE OF THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID, IF ANY, TO NOTIKA AI IN THE LAST SIX MONTHS OR $100, WHICHEVER IS GREATER.

Any disputes arising from these Terms will be resolved through final and binding arbitration in accordance with the American Arbitration Association’s Consumer Arbitration Rules. By agreeing to these Terms, you waive the right to a trial by jury or to participate in a class action.

Notika AI may suspend or terminate your account or use of the Service at any time, with or without cause, with or without notice. Any suspected fraudulent, abusive, or illegal activity may be referred to law enforcement authorities. Notika AI will not be liable to you or any third party for any termination of your access to the Service.

These Terms of Service constitute the entire agreement between you and Notika AI governing your use of the Service. These Terms will be governed by the laws of the State of New York without regard to its conflict of law provisions. If any provision of these Terms is found invalid, the remaining provisions will remain in full force and effect.
